Terms of Service.
The rules of the road. Please read these terms carefully before accessing the EV-UP network or utilizing our charging hardware.
By utilizing EV-UP network stations, you agree to operate the equipment safely and in accordance with provided instructions:
- Hardware Locks: Our stations utilize cryptographic auto-locks during active sessions. You agree not to forcefully remove or tamper with the charging cable before explicitly terminating the session via the EV-UP app.
- Emergency Stops: The physical E-Stop button on the hardware is for emergencies only. Misuse of the E-Stop that requires unnecessary technician dispatch may result in account suspension and service fees.
- Liability for Damage: You are responsible for any physical damage caused to the liquid-cooled cables, connectors, or station screens due to negligence or improper handling.
EV-UP operates on a prepaid wallet system in Malaysian Ringgit (RM).
- Charging Rates: The charging fee is calculated based on a formula using a fixed rate of RM0.80 per kWh. Rates are subject to change without prior notice.
- Pricing Updates: Wallet balances hold fiat currency value, not fixed energy credits. Sessions are billed at the prevailing RM/kWh rate at the exact time the session is initialized.
- Orphaned Transactions: If an FPX transaction times out but your bank is deducted, our system will automatically cross-reference webhooks and credit your EV-UP wallet within 24 hours.
EV-UP charging bays are strictly reserved for active charging sessions.
- Unauthorized Parking (ICEing): Parking an Internal Combustion Engine (ICE) vehicle, or an EV that is not plugged in, is strictly prohibited. Premier locations utilize ALPR (License Plate Recognition) cameras, and violators will be flagged to facility management for clamping or towing at the owner's expense.
- Clearance Limits: Certain premier residential hubs have a strict clearance height of 2.1 meters. EV-UP is not liable for structural damage to modified vehicles or roof racks exceeding this limit.
While we guarantee a 98% network uptime SLA for our software and server communications, EV-UP is not liable for external factors affecting your charge:
- Charging Curves: Your vehicle's Battery Management System (BMS) controls the acceptance rate (kW). EV-UP is not responsible for lowered charging speeds implemented by your vehicle to prevent lithium plating or thermal degradation.
- Grid Outages: In the event of a sudden municipal grid power failure, our stations will enter a safe-shutdown state. For safety reasons, sessions will not auto-resume, and EV-UP is not liable for incomplete charges resulting from utility grid faults.
By downloading the EV-UP application, registering an account, or plugging a vehicle into an EV-UP affiliated station, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service. EV-UP reserves the right to modify these terms at any time, with updates communicated via the application.
